These Terms of Use govern your access to and use of the services, platform, and content provided by Nexapulse ("we," "us," or "our") via nexapulse.sbs and any associated digital properties. By accessing or using our platform, you confirm that you have read, understood, and agree to be bound by these terms in full. If you do not agree, you must discontinue use immediately.
1. Acceptance of Terms
Your continued use of the platform constitutes your ongoing acceptance of these Terms of Use and any updates made to them. We reserve the right to modify these terms at any time. When changes occur, the revised version will be posted with an updated date. It is your responsibility to review these terms periodically.
2. Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, to use this platform independently. If you are accessing the platform on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
3. Account Registration and Security
3.1 Account Creation
Certain features of the platform require you to create an account. You agree to provide accurate, complete, and current information during registration and to update it as necessary to maintain its accuracy.
3.2 Account Responsibility
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at help@nexapulse.sbs if you suspect unauthorized access or any security breach involving your account.
3.3 One Account Per User
You may not create multiple accounts for the same individual. Duplicate or fraudulent accounts may be suspended or permanently removed without notice.
4. Permitted Use
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the platform strictly in accordance with these terms. You agree to use the platform only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the platform.
5. Prohibited Conduct
You agree not to engage in any of the following activities:

6. Intellectual Property
6.1 Platform Content
All content available on the platform, including but not limited to course materials, text, graphics, video, audio, software, and structural design, is the exclusive property of Nexapulse or its licensors and is protected under applicable intellectual property laws.
6.2 Restrictions
You may not copy, reproduce, distribute, publicly display, modify, create derivative works from, or commercially exploit any platform content without prior written consent from Nexapulse.
6.3 User-Submitted Content
By submitting content to the platform — including comments, project files, or feedback — you grant Nexapulse a worldwide, royalty-free, non-exclusive license to use, store, display, and distribute that content for operational and promotional purposes related to the platform.
7. Payment and Enrollment
7.1 Fees
Access to certain seminars and programs may require payment. All applicable fees will be disclosed prior to purchase. Prices are listed in the currency shown at checkout and are inclusive of applicable taxes unless otherwise stated.
7.2 Refunds
Refund eligibility is subject to the specific terms presented at the time of enrollment. We reserve the right to deny refunds where access to materials has already occurred.
7.3 Chargebacks
Initiating a chargeback without first contacting us may result in immediate account suspension pending resolution. Contact help@nexapulse.sbs to resolve any billing disputes.
8. Third-Party Services and Links
The platform may contain links to or integrations with third-party websites, tools, or services. These are provided for convenience only. Nexapulse does not endorse, control, or accept responsibility for any third-party content, practices, or policies. Your interaction with third-party services is governed entirely by their own terms.
9. Privacy
Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. By using the platform, you consent to the data practices described therein.
10. Disclaimer of Warranties
The platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Nexapulse does not warrant that the platform will be uninterrupted, error-free, secure, or free of harmful components. You use the platform entirely at your own risk.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Nexapulse and its officers, directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of or inability to use the platform, even if advised of the possibility of such damages. Our total aggregate liability to you shall not exceed the amount paid by you to Nexapulse in the twelve months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Nexapulse and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with your use of the platform, your violation of these terms, or your infringement of any third-party rights.
13. Termination
We reserve the right to suspend or terminate your access to the platform at our discretion, with or without notice, for conduct that we determine violates these terms, is harmful to other users, or is otherwise damaging to the platform or its reputation. Upon termination, your license to access the platform ceases immediately.
14. Modifications to the Platform
Nexapulse reserves the right to modify, suspend, or discontinue any part of the platform at any time, with or without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.
15. Governing Terms
These Terms of Use represent the entire agreement between you and Nexapulse regarding your use of the platform and supersede all prior or contemporaneous agreements, representations, or understandings. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
